    A lot of people don’t realize that criminal conspiracy requires less overt action than the crime the conspiracy is conspiring about. Legal Eagle had a great video on this recently.

    If I want to go to the store and buy an axe to kill someone, it’s not illegal if I say that and go to the store to buy an axe. The crime comes about when I attempt to use the axe to kill someone. BUT! If I text my friend and say I want to go to the store to buy an axe and then kill someone and my friend agrees. As soon as I go to the store to buy said axe, that is enough to convict on a criminal conspiracy.

    This comes back around because the charge is that Trump knew, communicated and encouraged his followers to commit illegal acts. And then they later did. They may not have achieved their ultimate goal of subverting the election, but it was still a conspiracy to do so.
